Co-responsibility
The Law on Medicinal products provides a penal co-responsibility between the companies which provide sponsorship and the (associations of) healthcare professionals who are the beneficiaries.
A posteriori controls
The Federal Agency for Medicines and Health Products (FAMHP) is the only competent to do a posteriori controls as to observance of the visa procedure. Mdeon’s tasks are limited to investigating the dossiers for sponsorship, based on pieces, without examining the accordance between the content of the visa application and the reality.
The Agency requires companies to have proofs of payment in order to be able to communicate it to Agency inspectors at any time during an inspection (even in the case of indirect sponsorship of healthcare professionals).
Sanctions
As to sanctions the law provides that the sponsoring company as well as the healthcare professional who receives the sponsorship can be fined (imprisonment of 1 month up to 1 year and/ore fines of 1.600 up to 120.000 euros).
